Legal Guide - Getting it Right Legally

EQUIPE in partnership with the law firm Bates Wells and Braithwaite has developed a handbook providing guidance on legal status and structures for childcare and play providers. The idea for the guide came from the responses of the groups across the country involved in developing and trialling the 4Children toolkit for Voluntary Management Committees called ‘Making it Happen’. The feedback was that groups needed more help on the legal side – specifically guidance on the different legal structures and forms of governance – in order to select the most appropriate legal form for what they wanted to do.

The new handbook, called Getting It Right Legally was launched on the 1st November 2005. The guide also includes a short training film on an enclosed DVD.

The guide is intended to provide helpful advice, but this is necessarily of a general nature and specific advice should be taken for specific circumstances. The guide is available in electronic form and can be download by clicking the image.

The model constitutions forming part of 'Getting it Right Legally - status and structure for play and childcare organisations' available from this website below, are for use as models to complement the advice given in the publication, not as fully formed constitutional documents for direct adoption and use without any intervening consideration and advice particular to your organisation.

Please read the attached note before using the model memorandums and articles below:
